DISTANCE SALES AGREEMENT

ARTICLE 1 – PARTIES

From now on, it will be referred to as "SELLER".

BUYER, www.capardiamond.com The natural or legal person who places an order, whether as a member of the website or not, will be referred to as the "BUYER".


ARTICLE 2 – SUBJECT OF THE AGREEMENT

The subject of this agreement is the purchase by the BUYER from the SELLER of the website www.capardiamond.com This agreement regulates the rights and obligations of the parties regarding the sale and delivery of the product, whose specifications and sales price are stated in the order placed electronically via the website, within the framework of the provisions of Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts.


ARTICLE 3 – PRODUCT AND ORDER INFORMATION

The product;

  • Name and key characteristics

  • Quantity

  • Sales price including VAT.

  • Payment method

  • Delivery address

  • Billing address

The information confirmed by the BUYER during the ordering process is as stated and is an integral part of this agreement.


ARTICLE 4 – GENERAL PROVISIONS

4.1 The BUYER acknowledges that they have read and approved the pre-information form regarding the product's essential characteristics, total sales price, payment method, delivery time, right of withdrawal, and return conditions.

4.2 The product will be delivered to the BUYER within a legal period not exceeding 30 days. This period may vary for custom-made products.

4.3 The SELLER is not responsible if the BUYER refuses delivery to a person other than the BUYER.

4.4 The SELLER cannot be held responsible for delays caused by the shipping company.

4.5 Since the products are handcrafted, there may be a ± 10% difference in weight, dimensions and grammage.

4.6 In the event of incorrect pricing due to a technical or material error, the SELLER reserves the right to cancel the order and refund the payment.

4.7 If delivery cannot be made due to force majeure (natural disaster, strike, war, pandemic, etc.), the BUYER may terminate the contract and the payment will be refunded within 14 days.


ARTICLE 5 – DELIVERY TERMS

  • Deliveries are made via our contracted shipping company.

  • Unless otherwise stated, shipping costs are the responsibility of the BUYER.

  • The product should be checked upon delivery, and damaged packages should not be accepted.

  • The buyer is responsible for any products received without a damage assessment report being filed.


ARTICLE 6 – PAYMENT AND REFUND TERMS

  • Payment can be made by credit card, bank transfer, or other methods offered on the site.

  • The security of the payment is the responsibility of the bank.

  • If payment is cancelled due to unauthorized use, the product must be returned.

  • The refund for returned products will be processed within 14 days of the product reaching the SELLER, using the same payment method used for the original purchase.


ARTICLE 7 – RIGHT OF WITHDRAWAL

7.1 The BUYER may exercise their right of withdrawal within 14 days of receiving the product without giving any reason.

7.2 In order to exercise the right of withdrawal, the product must:

  • Unused

  • Undamaged

  • Suitable for resale.

  • It must be sent with the invoice and all accessories.

7.3 Cancellation notice must be given in writing via email.

7.4 Unless otherwise stated, return shipping costs under the right of withdrawal are the responsibility of the BUYER.


ARTICLE 8 – CASES WHERE THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

According to Article 15 of the Regulation on Distance Contracts:

  • Products made to order

  • Custom orders made according to ring size.

  • Wedding rings with inscriptions

  • Products with changes in size, color, or model.

  • Products that cannot be returned due to hygiene reasons.

  • Orders with international delivery

  • Instant digital services

Due to Çapar Diamond's policy, ring orders can be cancelled with a 5% deduction.


ARTICLE 9 – RESOLUTION OF DISPUTES

In case of disputes, the Consumer Arbitration Boards and Consumer Courts in the buyer's place of residence have jurisdiction, within the monetary limits determined by the Ministry of Trade.


ARTICLE 10 – ENTRY INTO FORCE

By completing an order through the website, the BUYER is deemed to have accepted all the terms and conditions of this agreement.
